Apartments owners rights and duties
According to Section 13 of the statutes of the Leoparden 5 housing cooperative, dated 4 May 2021.
The co-op owner is responsible, among other things, for the following within the apartment:
a) Surface finishes on the room walls, floors, and ceilings, and the underlying preparation required to apply the finishes in a professional manner. The co-op owner is also responsible for the waterproofing layer.
b) Non-load-bearing internal walls.
c) Glass and frames in the apartment’s exterior and interior windows, including any muntins, blinds, fittings, hinges, handles, window espagnolette/locking mechanism, opening device, ventilation filter, and sealing strips, as well as all painting, including between window sashes. The same applies to balcony or patio doors and the associated threshold.
d) Replacement of the apartment entrance door and all associated fittings, hinges, glass, muntins, handle, doorbell, mail slot, and lock including keys. Exception: painting the outside of the entrance door.
e) Interior doors and security gate/grille.
f) Skirting boards, trim, casings, and moldings/stucco.
g) Fixtures and equipment such as kitchen and bathroom fittings, household appliances (refrigerator, freezer, stove/oven, dishwasher, washing machine, tumble dryer) as well as sanitary ware, bathtub, shower cabin, etc.
h) Pipes/cables and other installations for water, drainage, gas, electricity, and data/telecom transmission—provided they serve only the individual apartment.
i) Connection and distribution fittings on water pipes, including shut-off valve and water fixtures (e.g., tap, mixer, shower), including gaskets/seals, and the floor drain (if accessible from the apartment).
j) Cleaning/clearing of the floor drain, water trap, and pipes, as long as they are located inside the apartment and do not serve more than one apartment.
k) Electric radiator—only painting of the radiator and heating pipes in water-based systems.
l) Electric underfloor heating, electric towel dryer, fuse box, outgoing electrical wiring, switches, residual-current device (RCD), electrical outlets, and fixed light fittings.
m) Kitchen fan with hood (if the fan is not part of the building’s ventilation system). The co-op owner is always responsible for the hood’s light fitting and switch, as well as cleaning and replacing filters.
n) Smoke detector.
o) The owner’s own installations, unless otherwise stated in the bylaws.
Balcony or roof terrace
The co-op owner is responsible for cleaning and snow removal, and for ensuring that rainwater drainage is not obstructed.
The board’s permission is required to install any surface finish other than the original one.
Neglect
If the co-op owner neglects their responsibilities such that someone else’s safety is endangered or there is a risk of damage, the association may remedy the deficiency at the co-op owner’s expense.
Damage
The co-op owner is responsible for repairs in the event of fire or water damage only if the damage was caused by:
Their own carelessness or negligence, or
Someone in the household, a guest, a hired person, or a worker who caused the damage.
In the event of fire damage caused by someone other than the co-op owner, responsibility applies only if the owner failed to exercise due care or supervision.
These rules also apply in cases of pest infestation.
Fault reporting
Faults and deficiencies that fall under the association’s responsibility should be reported promptly by the co-op owner.
The association’s responsibility
The association is responsible for the building and everything that does not fall under the co-op owner’s responsibility, for example:
Drainage, heating, electricity, and water lines that serve multiple apartments.
Water-filled radiators (except painting), ventilation ducts and diffusers/vents.
Electricity up to the fuse box.
Surface treatment/painting of the outside of the apartment entrance door and visible parts of windows/balcony/patio doors.
Water-based (hydronic) towel warmers.
The ventilation system including fan and hood (if part of the building’s system).
Voluntary maintenance
The association may undertake to perform maintenance that is otherwise the co-op owner’s responsibility—provided that a decision is made at a general meeting, and that the measures are carried out in connection with major maintenance or rebuilding works.
